Our Criminal Lawyer – Mr Godwin Campos

Godwin graduated from the National University of Singapore and was called to the Bar in 1989. He has been in active practice for the past 27 years. Litigation with a focus on family law and general corporate advisory are his main areas of practice. Godwin spent 11years of his career at one of the top 5 law firms in Singapore and was a Partner and the Head of their Family Law Practice. In 2003, he started his own boutique law practice with a primary focus on domestic and cross border family law. He has appeared at all levels of the Singapore Court strata and has had significant decisions reported in the Singapore Law Reports. Godwin's forte lies in his precise and strategic problem-solving and this is well demonstrated in his near perfect record at hearings and trials. It is therefore not unsurprising that the firm relies in a great way on recommendations from existing and previous clients who continue to be the firm's strongest ally in channeling work. This remains clear testimony of the quality of work that is always delivered to each and every client.

In the legal circle, Godwin is well known as a leading family law practitioner and is often the "go-to lawyer" for other lawyers who seek him out when they require advice and guidance on family matters. The firm is recognized as one of the top 5 family law practices in Singapore and has won numerous awards in 2015 and 2016 as Boutique Family Law Firm of the Year in Singapore.

FAQ

  • Companies Act Offences
Companies Act offences can attract both civil and criminal liabilities. Certain offences under the Companies Act contain penal provisions which stipulate that violation can result in a criminal penalty, such as a fine or even imprisonment. Directors of companies should be especially alert to the provisions under the Companies Act.
  • Regulatory Offences
Regulatory offences are offences that are not necessarily considered ‘criminal’ in nature as they do not require satisfaction of the element of criminal intent to commit the offence. Rather, regulatory offences tend to attract civil and administrative penalties to deter the breach of regulations, such as those governed by the Securities and Futures Act, Code of Corporate Governance and Companies Act. Criminal penalties, which tend to be focused on ‘punishment’ and ‘denouncement’ of the offender’s behaviour, tend to be considered too draconian for these type of offences.
  • Penal Code Offences
The Penal Code (‘PC’) is the main statute in Singapore law governing criminal offences. Offences under the PC include inter alia offences relating to unlawful assembly, offences relating to religion or race, sexual offences, offences causing hurt to the person, assault, homicide and murder. Offences under the PC carry criminal penalties which may impose a fine or imprisonment or both, and in more serious offences, caning or the death penalty.
  • Drug Offences
Singapore has one of the strictest laws in the world relating to drugs-related offences. The Misuse of Drugs Act governs most drugs- related offences. These include inter alia the trafficking, manufacture, import, export, possession or consumption of controlled drugs.
  • Criminal Breach of Trust (‘CBT’)
Criminal Breach of Trust (‘CBT’) is an offence under the Penal Code which can be loosely defined as the ‘misappropriation’ or ‘conversion to own use’ of property by a person with whom that property has been entrusted for another contractual or legal purpose. An example of CBT is the use of funds provided to you by your employer for company purposes wrongfully for your own personal purposes. Even if you use the monies and reimburse the funds later with your own cash, you can be deemed to have already committed the offence of CBT.
  • Property Offences
Property Offences are governed by the Penal Code. These offences include inter alia theft, extortion, robbery, fraudulent disposition of property and criminal trespass. CBT is also an offence against property.
  • Corruption Offences
Singapore law is very strict in the policing of corruption offences. The principal legislation governing corruption offences is the Prevention of Corruption Act (‘PCA’). The Act prohibits the corrupt soliciting, receiving or agreement to receive, corrupt giving, promising or offering of gratification (or bribery). These prohibitions apply equally to the public and the private sectors. Both the recipient and supplier of a bribe can be charged under the PCA.
  • Road Traffic Offences
Offences under the Road Traffic Act (‘RTA’) include inter alia driving while using a mobile phone, exceeding the speed limit, reckless or dangerous driving and driving under the influence of alcohol. The RTA punishes offenders with the imposition of a fine, imprisonment or both. For certain offences, the RTA provides leniency in punishment for first-time offenders as opposed to repeat offenders.
